| Summary, etc | Tradicionalmente son responsables en el ámbito penal las personas naturales, pasando por alto la responsabilidad penal de las personas jurídicas, y en especial de las empresas. El desarrollo del derecho penal Suizo a pasado por estadios donde se trata de atribuir responsabilidad penal a dichos entes, con fundamento en el criterio de "irresponsabilidad de empresa" cuando no es posible la individualización del autor de la conducta ilícita que actúa bajo la ficción de la persona jurídica, pues la empresa tiene una responsabilidad social y ética que debe concretarse en normas civiles, administrativas y penales. |
