| Summary, etc | Resumen Muchas de las teorías romanistas tradicionales conciben el derecho contemporáneo como el fruto del derecho romano. Tales teorías sostienen, además, que el derecho de los antiguos romanos ha sobrevivido al pasar de los siglos llegando hasta la actualidad a través de un camino lineal de evolución y continuidad histórica. Sin embargo, diversos estudios realizados por historiadores del derecho sugieren un rompimiento con dicha continuidad. En este artículo se analizarán ambos argumentos con la finalidad de desvirtuar aquellos postulados que pretenden legitimar nuestro derecho a través de una supuesta evolución histórica. Logrando de esta manera que el lector conciba el derecho como un producto social que obedece a un contexto histórico determinado. |
