| Summary, etc | Resumen Entendida como disciplina jurídica, la Historia del Derecho merece repensarse desde y en función de los diferentes elementos que la integran: el ser memoria del jurista (como del derecho), el ser una especial historia de textos y, finalmente, el ser un discurso jurídico de esencial importancia en la orientación de sus estudios. Sobre este aspecto se fundarán las ideas del presente artículo, destacando a este respecto que la referencia al discurso como factor integrante de la Historia del Derecho permite, simultáneamente, forjar un camino epistemológico que identifica esta disciplina y, del mismo modo, le confiere la necesaria autonomía. |
