| Summary, etc | Resumen Este artículo revisa cuatro decisiones recientes, que otorgan medidas provisionales requeridas por los demandantes en cuatro arbitrajes de inversiones, a saber: las decisiones de tribunales CIADI en los casos City Oriente v. Ecuador and Petroecuador, Perenco v. Ecuador and Petroecuador, Burlington v. Ecuador and Petroecuador y las decisiones en el caso SCC de Sergei Paushok v. Mongolia. En la descripción de estas decisiones, el artículo analiza la tensión entre el derecho del Estado a implementar su política monetaria y los poderes de un tribunal arbitral para imponer restricciones a su ejecución vía medidas provisionales, pendiente la resolución de fondo de la controversia. |
