| Summary, etc | Resumen El Estatuto de Roma define las funciones y la atribuciones de la Corte Penal Internacional y determina “las reglas de juego” de esta jurisdicción internacional penal permanente. No obstante, el alcance del Estatuto de Roma depende de los desarrollos de la jurisprudencia de la Corte y, en este marco, los elementos constitutivos de los crímenes de guerra se han venido desarrollando más allá de los enfoques clásicos del Derecho Internacional Penal y del derecho interno de los Estados. El presente estudio constituye una revisión teórica de las particularidades que se desprenden del elemento de “gravedad” aplicado a los crímenes de guerra y del tratamiento que se le ha venido dando en la jurisprudencia internacional penal, con particular atención en los casos de la Corte Penal Internacional. |
