| Summary, etc | La autora presenta la fundamentación política y constitucional, así como las explicaciones filosóficas que llevaron a las sociedades modernas a la consagración de los códigos penales del delito de tortura. posteriormente analiza los diferentes elementos que estructuran el tipo penal de acuerdo con el legislador español, los desarrollos jurisprudenciales y, finalmente, analiza el problema de la tortura frente a la jurisdicción internacional y el principio de justicia universal. concluye señalando que la protección de las víctimas de estos hechos perpetrados por agentes del orden es una tarea continuamente pendiente en un Estado democrático de Derecho. |
